EEOC issues Q&A on its proposed ADAAA regulations
On September 17, 2009, the US Equal Employment Opportunity Commission (EEOC) issued Questions and Answers on the Notice of Proposed Rulemaking for the ADA Amendments Act of 2008, a question-and-answer document (Q&A) concerning its proposed rule implementing the ADA Amendments Act of 2008 (ADAAA).
The ADAAA, enacted on September 25, 2008, was effective on January 1, 2009. The law made significant changes to the definition of “disability.” The Commission voted 2-1 on September 16 to approve a Notice of Proposed Rule Making (NPRMP) that is expected to be published in the Federal Register the week of September 21.
The NPRM proposes changes both to the ADA regulations and the Interpretive Guidance (also known as the Appendix) that was published at the same time as the original ADA regulations. The Appendix provides further explanation on how the regulations should be interpreted.
The Q&A provides answers to a series of ADAAA-related questions, and in some cases, includes citations to specific sections of the proposed regulations and the corresponding section of the proposed Appendix (29 CFR Section 1630), or to portions of the current ADA regulations that were not changed by the ADAAA. These citations identify where particular issues are addressed in the proposed regulations or clarify what parts of the current regulations are unaffected by the proposed regulations.
