Illinois Tech Workers Must Report Child Pornography Found On Computers
Illinois has enacted a new law requiring certain electronic and information technology workers to report on any child pornography found while installing, repairing, or otherwise servicing an item of electronic and information technology equipment. Either the worker or the worker's employer must immediately report the discovery to the local law enforcement agency or to the Cyber Tipline at the National Center for Missing and Exploited Children. A worker or the worker's employer who reports on such a discovery of child pornography is immune from any criminal, civil, or administrative liability in connection with making the report, except for willful or wanton misconduct. A failure to report a discovery of child pornography is a business offense subject to a fine of $1,001. This law applies to a worker who in the scope and course of his or her employment or business installs, repairs, or services electronic and information technology equipment for a fee. However, the law does not apply to the following workers: (a) an employee, independent contractor, or other agent of a telecommunications carrier or telephone or telecommunications cooperative; or (b) an employee, independent contractor, or other agent of a provider of commercial mobile radio service ( Public Act 95-944 (H.B. 4578), L. 2008, effective August 29, 2008).
