EEO-1 Report (Title VII employers)

Who must file an EEO-1 Report? The EEO-1 Report must be filed by Title VII employers with 100 or more employees or affiliated companies whose total enterprise employs 100 or more employees. It must also be filed by nonexempt prime federal contractors or first-tier subscontractors with 50 or more employees who have a contract, subcontract, or purchase order amounting to $50,000 or more or who serve as a depository of Government funds in any amount, or who are a financial institution that is an issuing and paying agent for US Savings Bonds and Notes.

When is the EEO-1 Report filed? September 30 of each year (extended to October 15 for the 2008 Report due to server problems with the online system).

How is the EEO-1 Report filed? The preferred method of filing is through the EEOC's web-based filing system, which can be accessed at https://apps.eeoc.gov/eeo1/eeo1.jsp . This method replaces the interactive diskette method used before 2003. The EEOC also accepts reports submitted via data file, but no longer accepts computer-printed reports.

What regulations establish the reporting requirement? The EEO-1 Report is required under 29 CFR 1602.7 and 41 CFR 60-1.7.

New format for 2007. Employers started using a new version of the Employer Information Report (EEO-1 Report) to file their 2007 reports. The revised EEO-1 Report, which had been under consideration for two and one-half years, represents the first major change to the employer survey in four decades. It reflects the Office of Management and Budget’s revised standards for classification of federal data (see ¶14,020).
