Sample Vacation Policy Clauses
The following sample policy clauses are for vacation leave. Generally, vacation is paid leave with no loss of credit for the employee's length of service with the organization.
Part-time employees
As a part-time employee of the Organization, you are also entitled to a paid vacation. This vacation is granted after your first calendar year of employment and will consist of one week. The amount of vacation pay will be determined by dividing the number of hours worked in the previous year by 52 and multiplying that number by your current hourly rate.
Illness on vacation
If you are hospitalized while on vacation, the time from the date of your hospitalization until your doctor releases you to return to work may be charged against your short-term disability benefits rather than your vacation time. You must notify your supervisor if this happens.
If you become ill while on vacation, but are not hospitalized, your absence is charged against your vacation time
Calculation of final vacation pay
Payments due to the employee for any vacation earned but not taken will be included in the employee's final paycheck.
- Vacation time taken but not earned will be deducted from the employee's final paycheck.
- Entitlement to benefits will be based on the employee's service on the date of termination.
- Vacation payment is made at the employee's rate of pay in effect at the time of termination.
- Payment includes applicable shift premiums, pay differentials and allowances authorized at the time of termination and is based on the scheduled number of hours per week from 20 to 40.
- Payment is not to exceed eight hours per day or 40 hours per week.
Vacation entitlement when leaving employment
If you voluntarily leave your employment after providing proper notice, you will receive payment for any unused, earned vacation time (subject to state law). No unused, earned vacation time will be paid if you are terminated for cause.
Vacation entitlement taken in hours
You may schedule your vacation in increments of 2 hours in lieu of taking a whole day of vacation. All vacation must be scheduled in advance with your supervisor.
Sample vacation policy
Entitlement. Employees hired between July 1 and December 31 of the previous year, and who are actively employed on July 1 of the year in which the vacation occurs, will receive one week's (40 hours) vacation with pay. Employees hired on or after January 1 of the vacation year will have no vacation entitlement in that year.
Employees with one year of continuous service as of July 1 of the vacation year who are actively employed on that date will receive two weeks' (80 hours) vacation with pay.
Employees having more than five years' continuous service will receive additional pay for years in excess of five equal to one-half day's pay (4 hours) for each additional year to a maximum of 10 years.
Employees who complete 10 years of continuous service during the calendar year will receive three weeks' (120 hours) vacation with pay.
Employees who complete 20 years of continuous service during the calendar year will receive four weeks' (160 hours) vacation with pay.
It will not be permissible to accumulate vacations from one vacation year to the next, to combine vacation with other leaves or to receive payment in lieu of vacation.
Pay. Vacation pay will be computed on the basis of 40 hours per week times the employee's regular base hourly rate on July 1 of the calendar year.
Termination. Employees who terminate for any reason (including layoff) and who have been in the continuous service of the organization more than one year beyond the first July 1 of employment, will be paid their full vacation pay, provided they work or are credited with a total of nine months from the previous July 1.
Those employees who terminate who have more than one year of service, as above, and who have not worked a total of nine months since the previous July 1, will receive a pro rata vacation pay base on 1/9th for each full month worked after July 1.
Plant shutdown. The organization may close the plant during the vacation period, between July 1 and September 1. Employees would be expected to take their vacation during this period. Those entitled to vacation beyond the length of the shutdown period will take the extra vacation at a time agreed upon by the employee and the supervisor. Employees will be paid their full vacation pay on the last day preceding the plant vacation shutdown.
Rehires. Employees who are terminated and subsequently rehired will receive past service credit for vacation computation if their period of absence is less than the period of time worked prior to terminations. If the period of absence is greater than the period worked prior to termination, past service credit will be given after one year of re-employment. In no case will credit be allowed for the period of absence.
