Kentucky, Voting Leave Law Summaries
Kentucky's voting leave law is located in the Kentucky Revised Statutes Annotated at Title X, Ch. 118. The full text of the law is available at Wages-Hours ¶18-60,001. Voting leave regulations pertaining to state employees are located at 101 KAR 2:102E and 101 KAR 3:015E.
COVERAGE
All employers are covered under Kentucky's voting leave law.
WHAT THE EMPLOYER MUST DO
Employers must provide employees enough reasonable time, but not less than four hours, between the opening and closing of the polls in which to vote (Sec. 118.035, as amended by H. 6, L. 1998, effective February 17, 1998).
Employers may require that employees apply for voting leave prior to election day (Sec. 118.035, as amended by H. 6, L. 1998, effective February 17, 1998).
Employers may specify the hours that an employee may be absent (Sec. 118.035, as amended by H. 6, L. 1998, effective February 17, 1998).
Public employers.- An employee in the state service who is eligible and registered to vote will be allowed, upon prior request, four hours for the purpose of voting. An election officer will receive additional leave if the total leave for election day does not exceed a regular workday. The absence may not be charged against leave. An employee who is not scheduled to work during voting hours will not receive voting leave and will not be entitled to compensatory leave in lieu of time off to vote. An employee who is permitted to work in lieu of voting leave will be granted compensatory leave on an hour-for-hour basis for the hours worked on election day (101 KAR 2:102E and 101 KAR 3:015E, as amended effective November 4, 1999).
