Sample AIDS testing clauses

The following clauses address the issue of HIV and AIDS testing in the workplace and can be easily added to your company AIDS policy. For a complete sample AIDS policy, see ¶85,050 .

  • At this time, the company does not require employment testing; however, the company preserves its right to require testing that may or may not include blood screening for HIV. In the event testing is done, it will be done only if there is a clear business purpose, and employees will be advised by the company newsletter prior to implementation.

  • In the event testing is required, the employee requested to be tested will have the opportunity to select a physician to perform the tests from a list of at least three (3) physicians that will be provided by the company.
