Sample policy banning smoking on or off the job
This policy is designed for use in an employee handbook or other document that contains separate sections outlining the consequences of violating company policies. If a smoking policy is used as a standalone document, it should include a statement of the consequences employees face if they violate the policy.
Many states have enacted laws that prohibit discrimination against employees and job applicants who smoke outside of their employer's premises during nonwork hours. Be sure to consult the laws in your state to see what requirements you may be subject to regarding restricting the off-duty use of tobacco products.
Total Ban on Smoking On or Off the Job
The Company recognizes that tobacco products pose a known serious health risk to those who use them. Smoking carries many costs, including higher medical expenses and reduced productivity. In addition, the Company seeks to project the image of a company that supports and fosters healthy living habits. For these reasons, the company does not employ anyone who uses tobacco products.
