How are decertification elections conducted?

A decertification election is conducted in the same fashion as an initial representation election. A showing of interest (in decertifying the union, in this instance) is first required, and a petition filed. Construction of the bargaining unit, voter eligibility determinations, election objections, and other procedures parallel those used in the representation context. Similarly, the union and employer typically engage in the same kind of campaigning leading up to an election to convince employees to vote in their favor.

If the union wins the decertification election, and the employees choose not to remove it as their bargaining representative, then the union is certified again as the exclusive bargaining representative of the employees within the bargaining unit. If the union loses the election-or if the election ends in a tie-the union is decertified.
