Must employees be given time off when a family member is serving in the military?

While USERRA does not provide leave to family members of military servicemembers, the federal Family and Medical Leave Act (FMLA) now does. Under amendments enacted in 2008, eligible employees are entitled to take unpaid FMLA leave relating to a covered family member's service in the Armed Forces. For more information, see ¶45,420 .

In addition, a growing number of states require employers to provide time away from work to a family member of a person on active military duty. Be sure to check State Laws for the law applicable in your state(s).
