What changes to the I-9 form took effect as a result of the 2009 revision?

In December 2008, the US Citizenship and Immigration Services published an interim final rule revising the list of documents acceptable for the Form I-9 employment eligibility verification process. Scheduled to take effect on February 2, 2009, the rule went into effect on April 3, 2009, at which time employers were required to use a revised Form I-9 for all new hires and reverifications. The version of the Form I-9 currently in use carries the date 02/02/09 in the lower right corner of the form.

Employers may only accept documents listed on the List of Acceptable Documents on Form I-9 (see ¶36,240 ).

Significant changes to the Form I-9 include:

  • the elimination of expired documents as proof of identity or work authorization,

  • the elimination of three documents from List A

    • Temporary Resident Card, Form I-688, and

    • older versions of the Employment Authorization Card, Forms I-688A and I-688B,

  • the addition of three List A documents

    • the new US passport card,

    • a temporary I-551 printed notation on a machine-readable immigrant visa in addition to the foreign passport with a temporary I-551 stamp, and

    • valid passports for citizens of the Federated States of Micronesia and the Republic of the Marshall Islands, along with Form I-94 or Form I-94A indicating nonimmigrant admission under the Compact of Free Association Between the United States and the FSM or RMI,

  • revision of the employee attestation section.
