What happens after a union is decertified?

Once a union loses a decertification election and is decertified by the National Labor Relations Board, an employer is no longer obligated to bargain with the union. In fact, because the union no longer represents a majority of its employees in the bargaining unit, it would be unlawful for the employer to recognize and bargain with the union. An employer once again has autonomy to make managerial decisions without consulting the union, even where they might affect the terms and conditions of employment for its workforce. The employer can also deal directly with its employees to negotiate employment terms if it wishes.
