Termination of employment will not relieve the employer's liability for garnishment of any wages owed to the employee at the time the notice of garnishment is received. In many states, the employer's liability for the garnishment is limited to the amount owed to the employee at the time the notice is received. In such states, termination of employment will in no way relieve the employer's liability for the garnishment.
Does the employer's responsibility for a garnishment end upon the employee's termination? Many states require that your organization notify the court, the person to whom payments are being made or the proper enforcement agency (for example, the child support agency) when an employee is no longer working for your organization, whether because the employee was discharged or quit.
