California's law dealing with polygraph testing in employment is located in the California Labor Code at Division 2, Part 1, Chapter 3, Article 3, Section 432.2.

COVERAGE

Private employers only are covered by California's polygraph testing law.

EXCEPTIONS

The rule against requiring employees to submit to polygraph testing does not apply to the federal government or its agencies, or to the state government or any agency or local subdivision, including, but not limited to, counties, cities, districts, authorities and agencies (Sec. 432.2).

PROCEDURES

An employer may not ask a person to take a polygraph test or administer such a test, without first advising the person in writing, at the time the test is to be administered, of the rights guaranteed by law (Sec. 432.2).

WHAT THE EMPLOYER MUST DO

No employer may demand or require any applicant or any employee to submit to or take a polygraph, lie detector or similar test or examination as a condition of employment or continued employment (Sec. 432.2).
