Delaware's maximum hours provisions are located in the Delaware Code Annotated at Titles 11, 14 and 19. The full text of the laws is available beginning at Wages-Hours ¶8-44,011.

WHAT THE EMPLOYER MUST DO

Child labor.- For a complete summary of Delaware's child labor law, see ¶8-1500 et seq.

Minors under 16.- A minor under 16 years of age must not be employed or permitted to work more than (Sec. 506):

  1. four hours on any day when school is in session;

  2. eight hours on any day when school is not in session;

  3. 18 hours in any week when school is in session for five days;

  4. 40 hours in any week when school is not in session; and

  5. six days in any week.

The hours worked by a minor enrolled in a bona fide work-study or student-learner program when school is normally in session are not counted towards the permissible hours of work prescribed above (Sec. 506).

The time spent in a part-time school or class by a minor under the age of 16 years must be counted as a part of the time or number of hours the minor is permitted by law to work (Title 14, Pt. I, Ch. 35, Sec. 3509).

Minors under 18.- A minor under 18 years of age must not spend more than 12 hours in a combination of school hours and work hours per day (Sec. 507).

Public employers: State police.- A workweek for State Police members appointed by the State Police Department is five days a week, 40 hours a week. Longer workweeks during times of special need can be declared by the Department, upon specific recommendation of the Superintendent of State Police (Sec. 8306).

Public schools.- A workweek for State Board of Education and State Board for Vocational Education employees is 37.5 hours per week (Sec. 1330).
