Illinois, Polygraph Testing Law Summaries
Illinois' polygraph testing law is located in the Illinois Compiled Statutes Annotated at Chapter 225 (Detection of Deception Examiners Act).
DEFINITIONS
“Examiner” means any person licensed under Illinois' Detection of Deceptions Examiners Act (Sec. 430/1).
COVERAGE
The prohibited areas of inquiry during a detection of deception examination apply in both preemployment and periodic employment examinations (Sec. 430/14.1).
EXCEPTIONS
Examiners may inquire into the areas listed below if the area is directly related to employment (Sec. 430/14.1).
WHAT THE EMPLOYER MUST DO
No examiner may inquire into any of the following areas during preemployment or periodic employment examinations, unless the area is directly related to employment (Sec. 430/14.1):
religious beliefs or affiliations;
beliefs or opinions regarding racial matters;
political beliefs or affiliations;
beliefs, affiliations or lawful activities regarding unions or labor organizations; or
sexual preferences or activity.
Voice stress analyzers.- A voice stress analyzer is prohibited for use in preemployment screenings. “Voice stress analyzer” means an investigative tool that records voice stress factors related to frequency modulations in the human voice (225 ILCS 430/4, as amended by H. 577, L. 2003, effective December 15, 2003).
