Kansas, Access to Personnel Files Law Summaries
Kansas has no general law relating to employee access to personnel files, but the state does have some statutory provisions on the topic with respect to certain school employees (see below).
WHAT THE EMPLOYER MUST DO
Each board of education of a school district, the governing authority of any nonpublic school offering any of grades kindergarten through 12 in accredited schools, and the board of control of an area vocational-technical school shall adopt a written policy of personnel evaluation procedure. Every policy so adopted shall provide that all evaluations are to be made in writing and that evaluation documents and responses thereto are to be maintained in a personnel file for each employee for a period of not less than three years from the date each evaluation is made (Sec. 72-9003, as amended by Ch. 45 (S. 436), L. 2005, enacted March 27, 2006, effective and in force from and after its publication in the statute book).
Each board of trustees of a community college shall adopt a written policy of personnel evaluation procedure. Every policy so adopted shall provide that all evaluations are to be made in writing and that evaluation documents and responses thereto are to be maintained in a personnel file for each employee for a period of not less than three years from the date each evaluation is made (Secs. 3 and 4, Ch. 45 (S. 436), L. 2005, enacted March 27, 2006, effective and in force from and after its publication in the statute book).
