Kansas' genetic testing law is located in the Kansas Statutes Annotated at Chapter 44, Article 10.
DEFINITIONS
“Genetic screening or testing” means a laboratory test of a person's genes or chromosomes for abnormalities, defects or deficiencies, including carrier status, that are linked to physical or mental disorders or impairments, or that indicate a susceptibility to illness, disease or other disorders, whether physical or mental, which test is a direct test for abnormalities, defects or deficiencies, and not an indirect manifestation of genetic disorders (Sec. 44-1002, as amended by S. 22, L. 1999, effective upon publication in the statute book).
WHAT THE EMPLOYER MUST DO
It is an unlawful employment practice for any employer to (Sec. 44-1009, as amended by S. 22, L. 1999, effective upon publication in the statute book):
seek to obtain, to obtain or to use genetic screening or testing information of an employee or a prospective employee to distinguish between or discriminate against or restrict any right or benefit otherwise due or available to an employee or a prospective employee; or
subject, directly or indirectly, any employee or prospective employee to any genetic screening or test.
