Kansas, Holiday and Vacation Law Summaries
Kansas' holiday law is codified in the Kansas Statutes Annotated at Chapter 35. Kansas' statutory provisions dealing with vacation are located in the state's wage payment law (Kansas Statutes Annotated, Chapter 44, Article 3), the relevant portions of which are summarized below. COVERAGE
Kansas' holiday law covers only state government employees.
WHAT THE EMPLOYER MUST DO
Holidays defined.- On and after January 1, 2006, the following days are declared to be legal public holidays and are to be observed as such (Sec. 35-107, as amended by Ch. 111 (S. 26), L. 2005):
January 1, New Year's Day;
Martin Luther King, Jr. Day, the third Monday in January;
President's Day, the third Monday in February;
last Monday in May, Memorial Day;
July 4, Independence Day;
first Monday in September, Labor Day;
second Monday in October, Columbus Day;
November 11, Veterans' Day;
fourth Thursday in November, Thanksgiving Day;
December 25, Christmas Day.
In addtion, the following days are legal holidays for the state service: New Year's Day, Memorial Day, Independence Day, Labor Day, Veterans' Day, Thanksgiving Day; Christmas Day; and additional days designated by the governor on which state offices will be closed (Kan AdminRegs, Sec. 1-9-2).
NOTICE
Holidays falling on weekends.- For state employers, when a legal holiday falls on Saturday, the preceding Friday is the officially observed holiday for state employees. When a legal holiday falls on Sunday, the following Monday is the officially observed holiday for state employees (Kan AdminRegs, Sec. 1-9-2).
Vacation policies.- Each employer must, upon the request of the employee, make available to such employee in writing or through a posted notice maintained in a place accessible to its employees or as required by a collective bargaining agreement, employment practices and policies with regard to vacation pay (Sec. 44-320).
Vacation pay upon termination.- for state classified employees who separate from state service must be paid for accumulated vacation leave, compensatory time and holiday compensatory time in a lump sum (Kan AdminRegs, Sec. 1-9-13). Unclassified employees must be compensated for accrued vacation leave, but not for vacation leave granted as a starting balance (E.O. 2004-13).
