The Guidelines on Discrimination Because of Sex in the Kansas Administrative Regulations (Agency 21, Article 32, Section 21-32-4) interpret discrimination in employment against married women to be discrimination based on sex prohibited by the Kansas act against discrimination (see ¶17-2500).

COVERAGE

Discrimination in employment against married women is prohibited as sex discrimination under the Kansas act against discrimination (Sec. 21-32-4).

WHAT THE EMPLOYER MUST DO

The Human Rights Commission has determined that an employer's rule that forbids or restricts the employment of married women and that is not applicable to married men is a discrimination based on sex prohibited by the Kansas act against discrimination (see ¶17-2500 et seq. ) (Sec. 21-32-4).

An employed woman should not have her employment terminated when she marries a man who works for the same business or institution by whom she is employed. At the same time, a woman should not be denied employment by an employer due to rules against nepotism if she is otherwise qualified to perform the required work (Sec. 21-32-4).
