Maine, Age Discrimination Law Summaries

Age discrimination in employment is prohibited by the Maine Human Rights Act (Maine Revised Statutes, Title 5, Part 12, Chapter 337 -reported at ¶20-2500), and by provisions in the state's civil service law (Maine Revised Statutes, Title 5, Part 17-A, Chapter 372, Subchapter II, Article I, Section 7051), which are summarized below. However, see ¶20-2500 for any provisions that may apply under the Maine Human Rights Act.

C0VERAGE

Maine's civil service law applies to public employment only.

EXCEPTIONS

Bona fide occupational qualification

Discrimination in civil service employment on the basis of age is allowed if based on a bona fide occupational qualification (Sec. 7051).

WHAT THE EMPLOYER MUST DO

No discrimination may be made in the state civil service because of age, unless based upon a bona fide occupational qualification (Sec. 7051).
